Terms and Conditions

General Terms and Conditions - Wearnet reserve the right to suspend or terminate any customer who breaks this agreement.

Spam - Sites engaged in the sending of unsolicited bulk email will not be allowed on the server and will be summarily terminated if discovered. Opt-in (not unsolicited) bulk mail may only be sent with the prior written approval of Wearnet. We will impose certain restrictions which must be agreed to before permission is given.

Payment - Payment is made in advance of the start of each period. Payment is usually annually in advance but monthly, by direct debit, can be arranged. Renewals begin on the anniversary of the initial connection and must be paid for prior to the anniversary to prevent automatic suspension. Reminders are sent out to the site administrator's email around 21 days prior to renewal.

Illicit and illegal material - all sites on our servers must comply with UK law, including copyright law and laws concerning obscene, offensive and discriminatory material.

Charges - Costs for hosting websites and emails vary with usage and other facilities. Usage costs are data transfer and disk space used by the website, email accounts, backups and all other activity and storage related to the customer's URL. See our tariff matrix for more information. Usage is calculated by the customer, or someone acting on his behalf, prior to the start of each annual connection or renewal. Should the customer exceed the limits imposed by the agreed tariff notification will be sent by email. In the event of an excess, a one-off charge will be levied or an upgrade may be offered.

Charges are on an annual basis in advance and are not refundable. Any customer wishing to vacate the server during the year may do so provided that their account is fully up to date. At the end of any particular period (account year), non-payment of the account will be taken as termination by the customer. Once termination has taken place, the server will be unavailable for access by the client so we do suggest that removal of any data, website, emails etc is carried out prior to termination.

Should a site be suspended due due to customer request or non-payment, a reconnection charge will be levied and must be paid, together with any outstanding amounts, prior to unsuspension.

Wearnet reserve the right to amend our charges without notice.

VAT - All charges are exclusive of VAT, which must be paid by the customer if due.

Backups - Wearnet take regular backups of their servers, including our customers' websites and of the websites of customers whose tariff includes a backup service. This is carried out in good faith but we cannot be held responsible for failure of the server or the backup. We also provide our clients with the facility to do their own backups, both on the server and externally. We strongly suggest that they take advantage of this service.

Liability - Whilst downtime of the server is minimal, Wearnet cannot be held responsible for any inability of the client or their customers to access the server. No warranty is implied or given for any service that we offer from our webservers.
